Justice Department Sues California Over Transgender Athlete Civil Rights Case

Trump Administration Challenges California’s Transgender Athlete Policy in Federal Court

The Justice Department filed a federal lawsuit against California, alleging the state violated civil rights laws by permitting transgender athletes to compete in school sports. The legal action targets California’s policy allowing students to participate based on their gender identity rather than biological sex.

Federal prosecutors claim California’s approach discriminates against female athletes by creating unfair competition. The lawsuit argues that allowing transgender women to compete in girls’ sports violates Title IX protections designed to ensure equal opportunities for female students.

California has maintained one of the nation’s most inclusive policies regarding transgender student athletes. The state’s law, enacted in 2013, permits students to participate in sports and use facilities matching their gender identity. State officials have defended the policy as protecting all students from discrimination.

The legal challenge represents a broader national debate over transgender rights in education. At least 20 states have passed laws restricting transgender athletes from competing in sports aligned with their gender identity. Meanwhile, other states like California have adopted more inclusive approaches.

The lawsuit seeks to force California to change its current policy and potentially bar transgender athletes from competing in girls’ sports. Legal experts predict the case could reach the Supreme Court, given the constitutional questions involved.

California Attorney General Rob Bonta has not yet responded to requests for comment regarding the federal lawsuit.
